Following the breakdown of a relationship, parents may have concerns about their child having contact with their other parent. There are numerous and valid reasons for such concern – for example, in circumstances where there are allegations of drug use, domestic abuse, or other behaviours which may have a negative impact on the child.
However, it is important to note that you cannot stop your former partner from seeing your child without a court order. A court will only make an order providing no contact between a parent and child in very limited circumstances, where it believes that such contact is likely to cause the child harm. If there are concerns about a parent’s behaviour, it is more likely that the court will order reduced, restricted or supervised contact.Ultimately, the court’s primary consideration will be the welfare of the child, and any order for contact should reflect this.
