Parents are legally required to financially contribute to their children’s upbringing, until they are at least 16. Following the breakdown of a relationship, one parent’s contribution will generally take shape in the form of child maintenance, or child support.
If your former partner is refusing to pay child maintenance, in most cases your first step should be to contact the Child Maintenance Service (CMS) and request that they assess how much maintenance should be paid, if they haven’t already. The government website provides a helpful calculator tool which estimates how much the CMS will determine should be paid: Calculate your child maintenance - GOV.UK
The CMS can collect child maintenance payments on your behalf and take enforcement action against your former partner if they continue to refuse to pay. To collect any arrears, the CMS can directly deduct the sums owed from their salary, pension, or bank account.
If your ex is refusing to pay child maintenance which has been ordered by the court, there are various enforcement mechanisms in place which the court will use to ensure compliance.
